Speaker cannot convene parliament: Govt.

The government yesterday said Speaker Karu Jayasuriya has no legal right to reconvene parliament today (14) and that it would make a decision this morning regarding its MPs and Ministers attending parliament.

Minister Nimal Siripala De Silva said their counsels were still studying the Supreme Court’s interim order given suspending parliament dissolution.

“After seeking legal opinion and having further discussion at our group leaders meeting this morning, we will make a decision about attending parliament sessions,” he told a news briefing.

The group leaders meeting is scheduled to take place at 8.30 am in parliament complex today.

Meanwhile, Minister Wimal Weerawansa said Speaker has no legal authority to convene parliament. “There is no legal recognition in this move. We reject it. Speaker has called for the reconvening of parliament to satisfy a group of Opposition MPs and to show to the world that Sri Lanka is having a crisis,” he said.

He said parliament remained dissolved since the interim order of Supreme Court has only suspended the gazette issued by the President dissolving parliament.

“Unless the Supreme Court issues an order entirely cancelling the Gazette, parliament remains dissolved. Just because the Gazette was suspended, it doesn’t reverse the dissolution,” he said. (Lahiru Pothmulla)

    Interim Order against dissolution means ,supreme court has turned to president and has says "HE,you cant dissolve Parliament until we decide constitutionality of your action ",which means it removes the status of dissolution.

    As far as I can see Extra ordinary gazette order to convene parliament issued by Prez not been withdrawn. Also SC issued an interim order suspending his subsequent Gazette to dissolution which mean until a final decision Prez gazette regarding dissolution not be valid or interpreted in any way. There is no legal standing for this. Therefore speaker has all the rights to act on original Gazette to convene the parliament is legitimate and bona fide.     Normally GLP would be given the job of commenting on legal matters , but this time the statement was so obsurd that even the professor wouldn't utter it. Instead they gave the job to that eminent legal expert WW, who has decided that the Supreme Court's stay order on MS's gazette notification to dissolve parliament doesn't actually stay the dissolution, and that parliament remains dissolved. In the real world the dissolution of parliament has been suspended and so parliament will reconvene today 14th November as per the gazette notification by MS, the Speaker is reconvening parliament on the order of the President .So, what is the President going to do next ??

    When the Supreme Court Stay the Gazette, it means that Gazette no longer have any effect and we will go back to how things were, which is Parliament remains and Presidents Gazette convening the Parliament on 14th remain. So Speaker can convene the Parliament on 14th based on president’s previous order.Mr. Nimal Siripala saying something else than what Supreme Court said, is interfere with Supreme Courts Judgment, and it is a contempt of court.

If court ruled out presidents gazette, that mean it is null, It does not have to issue another order. Crisis started stupid president and Mahinda who wanted to grab power cunningly. President have no authority to fire or appoint a PM. Parliament should do that.
