A doctor found guilty to the charges of raping a woman and pushing her off the sixth floor of the Negombo General Hospital was sentenced to death by Western Province High Court judge M.M.A. Gafoor today.

Dr. Indika Sudarshana Balage was also sentenced to fifteen years in jail and fined Rs.10,000.

In the case which lasted for 17 months, Doctor Indika Sudharshana Balage, a resident of Maradankadawala and a father of one child was also sentenced to 15 years rigorous imprisonment and fined Rs.10,000.

The doctor had murdered Dissanayake Mudiyanselage Chamila Dissanayake, a resident of Moneragala at Katukuramandiya on November 12, 2007.
The Attorney General had indicted the accused at the conclusion of the police investigations and without conducting a non-summary trial. The case was taken up for hearing Western Provincial High Court Judge M.M.A. Gafoor from April 29, 2013.

The accused had opted for the case to be heard without a jury.

It transpired that the victim Chamila had visited the Negombo Hospital on the advice of a private doctor for the treatment of a cyst in one of her breasts. She had been operated and had visited the hospital on a clinic day for further consultations and it was on that day that she met with her death at the hands of the hospital doctor. Dr B. Prasanna Priyanjith Perera, the senior lecturer of the Faculty of Judicial Medicine of the Kelaniya University testifying at the hearing confirmed that she had been a virgin prior to her death.

Fine's dont go to the Victim, a fine is a statutory requirement which goes back to the state.

The women's family can get money if they commence civil proceedings for wrongful death.

But since the respondent is in custody, he has no requirement to be pay any cost orders.
