The attorney of the slain underworld figure Makandure Madush, in a letter to the President of the Bar Association of Sri Lanka and the Inspector General of Police, said the narrative of the incident which led to the death of Madush was a "pure fabrication".

"It is recognized that as a civilized society which respects the Rule of Law, the recent spate of murders whilst in the custody of Law Enforcement agencies have gone unpunished with no investigation into the veracity of the narrative being forced down the public,” Attorney-at-Law Chaminda Athukorale said in his letter.

He further said, “It is recognized that no civilized society should condone this behaviour.”

“You are aware that the narrative put forth today by the Law Enforcement agencies regarding the murder of my client, is on the face of it, a pure fabrication. The transfer of Madush from the Criminal Investigations Department to the Colombo Crimes Division on October 16, 2020, was illegal and was a prelude to his murder.

"You are aware that in terms of the Prevention of Terrorism Act, such Detention Orders could only be made for a period of 18 months. Accordingly my client’s continued detention was to lapse on the October 28, 2020.

“Be that as it may, you are aware that the Detention Order in terms of the Law must specify the place of Detention. The said place of detention for the Detention Order numbered above, was the Criminal Investigations Department.

“However, illegally and arbitrarily my client was moved from the Criminal Investigations Department to the Colombo Crimes Division on or around October 16, 2020.
“The said move was illegal and was a prelude to the incident which took place last morning," the letter states.

The letter further says that no civilised society should condone such behaviour and says that the wife of Madush had in fact written to the Director of the Crimes Division on the October 17, 2020, detailing the manner and mode of the impending murder of her husband.

"Fearing such imminent threat to the life of my client his wife upon our advice wrote to the Director of the Colombo Crimes Division on the October 17, 2020 and informed them by way of phone call regarding the ruse by State Agencies. The said letter is annexed hereto for your reference.

“The letter specifies the clear fear and apprehension of the manner and mode of the murder of her husband whilst in Police custody" the letter states whilst calling on the Bar Association to condemn deaths whilst in Police custody in the strongest possible terms.

So do you'll justify the murders and other crimes he committed ?

Ruwan Fernando Wednesday, 21 October 2020 04:43 PM

    That isn’t the point here.

    mohandev Wednesday, 21 October 2020 04:45 PM

Madush's lawyer can file a FR case at the SC to find out the truth. Best way to test the 'independence of the judiciary'

    Mahesh Wednesday, 21 October 2020 04:49 PM

Is it ok to kill someone in police custody? It can happen to you too even if you are innocent or hss not committed any offense.

    Hari M Wednesday, 21 October 2020 04:55 PM

What a silly question? So we can all take the law into our hands and deliver justice, if we consider someone had committed a crime?

    D Kosgoda Wednesday, 21 October 2020 04:30 PM

These kind of murders are normal in so called democratic Srilanka

Sunil Ferreira Wednesday, 21 October 2020 04:38 PM

Lankawe ohoma thamai, I don't know why.

Neville Gunasekara Wednesday, 21 October 2020 04:39 PM

Those who live by arms shall perish with arms.

    Bandu L Wednesday, 21 October 2020 04:43 PM

They were fearful he was going to spill some very big beans

    Tintin Thursday, 22 October 2020 08:27 AM

His lawyer or anyone else can write as much letters as they wished. Request as many inquiries too. This alone is the reason for his murder. And certainly won't be the last of this kind.

Innocent citizen Wednesday, 21 October 2020 04:48 PM

Very few in the society, maybe his wife and illegal wife, will condone his death, whatever the way it happened. He was such a menace to the youth of this country in particular and the civilized society in general.

    Mahesh Wednesday, 21 October 2020 04:51 PM

On 18th a website published an article saying about this incident. Then it happened on 20th. Very strange....

    joshua Wednesday, 21 October 2020 04:53 PM

So you are talking on behalf of a notorious criminal ? The legal system just drags these cases at the expense of public funds. Although killing is the most cruel thing to a human kind, see the damage this fellow to the whole society?

    Tintin Thursday, 22 October 2020 08:30 AM

    කුමට මෙරට අධිකරණය, නීතිය සහ විනිසුරන්...?

    Alfred Wednesday, 21 October 2020 06:35 PM

People who earned from madush has pain .

    Saman Wednesday, 21 October 2020 07:37 PM

The real truth is politicians who associated and engaged the business with this man buried. This is what so called drama in Sri Kanka Hora Police game.

    Bernard Wednesday, 21 October 2020 07:48 PM

This is called extra-judicial killing in the guise of law-enforcement.

    VJ Wednesday, 21 October 2020 08:05 PM

Murdered and looted, supposedly had billions in 23 bank accounts.

Pantha Kumaran Wednesday, 21 October 2020 10:00 PM

Madush killing is unlawful like Lasantha Wickramtunge and many others. I am not supporting Madush because he is a criminal. Has been alive today he would have revealed few names to embarass the government. It is a political killing.

    sas Wednesday, 21 October 2020 10:29 PM

In a civilized society an accused is presumed to be innocent until proven guilty. The world community will decide whether our people are civilized or not.

    Ramasamy Wednesday, 21 October 2020 11:19 PM

For sure!! The lawyer will migrate to a European country..

IGNATIUS RASIAH Thursday, 22 October 2020 04:06 AM

Is someone covering their tracks by murdering Madush? Good luck Sri Lanka in finding out. You will need lots of it.

    hoodwinker Thursday, 22 October 2020 06:46 AM

Most probably already his Lawyer has the custody of all names ,incidents of important matters ,dates pertaining to his client .

    Niz Thursday, 22 October 2020 07:47 AM

Was it the first outing Madush went with the cops on a midnight walk operation and under whose instructions? He was brought down under foreign custody. It is a shame where the authorities are concerned and unable to do their job. Their names should be released after all they are being paid under tax payers money.
