The Colombo High Court yesterday released former MP Tiran Alles and three others from the case in which they were accused of misappropriating Rs.200 million belonging to the Reconstruction and Development Agency (RADA) in 2006.
When the case was taken up before Colombo High Court Judge Pradeep Hettiarchchi, Deputy Solicitor General (DSG) Dileepa Peiris appearing for the Attorney General’s Department informed Court, the prosecution would not proceed with the case because they did not possess several of the original documents pertaining to the indictments. “The case had changed from the previous situation and that had affected the maintainability of the case,” DSG Peiris said.
During the trial, the prosecution witness, former RADA CEO Chandrakathi Fernando informed Court that she had never seen some of the original documents pertaining to the indictments. DSG Peiris then informed Court that the prosecution witness had now taken a different stance contrary to the initial stage of the case and that had affected the prosecution.
In 2005 the AG had filed indictments against four accused -- Tiran Alles, RADA’s former Chief Operations Officer Saliya Wickramasuriya, former senior LTTE leader Emil Kanthan and Jayantha Dias Samarasinghe under the Penal Code and Public Property Act.
