The Court of Appeal yesterday issued an interim order staying the Avant Garde Bribery case proceedings in the High Court against Avant Garde Chairman Nissannka Yapa Senadhipathi and Rakna Lanka’s former chairman retired Maj. Gen. Palitha Fernando.
The revision application filed by Mr. Senadhipathi and Mr. Fernando was taken up for hearing by a Court of Appeal Bench comprising Justices Kumuduni Wickramasinghe and Devika Abeyratne who also fixed the application for support on September 2 while issuing notices to the Bribery Commission (BC) to present its submissions on this date.
On March 11, the Colombo High Court had rejected the preliminary objections raised by Nissanka Senadhipathi and Palitha Fernando pertaining to the Avant Garde Bribery case filed against them.
The defence said the BC had filed indictments against the accused without the written endorsements of the two other Bribery Commissioners.
