The sisters of the late Baratha Lakshman Premachandra said today that justice is being served in two spoons as the law applies differently to the rich.

“The law in this country applies to the rich in one way and the poor in another. There is no equality and justice in this country. You people are normal people imagine if something of this kind happens to you, the law will apply differently to those who have money. If you have money you could escape after committing any crime. That is the political situation in this country,” they said.

She also said that  many people were trying to cleanse the murder by being extra nice to the aggrieved party.
Speaking outside court Swarna Gunarathne a sister of the late former Presidential advisor and another sibling said that “charity is no substitute for justice withheld”.

Meanwhile the counsel of former presidential adviser Bharatha Lakshman Premachandra’s body guard complained of double standards in the
investigations carried out by the CID into the killing of four people including Mr. Premachandra at Mullriyawa.

Counsel Jagath Abeynayake made this complaint to Colombo Additional Magistrate Prasanna De Alwis.

He is appearing for MSD officer Rajapurage Gamini who functioned as Mr. Premachandra’s bodyguard at the time of the shooting.

The counsel said immediately after the incident his client who was admitted to the Police Hospital with severe injuries sustained to his
skull and the eye was taken into CID custody and remanded. The counsel said, however another suspect who had received the same
amount of injuries during the incident is enjoying comfortable treatment in a five-star hotel-like hospital in Singapore. He said
while his client was arrested while at the Police Hospital and remanded it was not so with the other suspect.

The counsel said this was how the law was implemented in this country. “It is because of the influence, the political authority and the
social status of the suspects,” he said.

The counsel informed the Magistrate that his client’s injured eye had been removed and a prosthetic eye implanted. The specialist doctors
who treated his client had advised that he should not be moved out of the prison hospital to a normal cell without their advice but the
Prison doctor had arbitrarily sent the patient back to the normal cell ignoring the specialist’s advice.

The counsel asked court to direct the doctor to state on what authority that she had ignore the specialist’s opinion. He said the
court was the domain for the layman to seek redress and there was no other place for litigants to seek justice.

President’s Counsel Jayantha Weerasinghe appearing for suspect Chaminda said for one year the Police had been habitually stating that
the investigations were over and they are awaiting the AG’s advice to proceed further with the case.

He asked CID ASP Shani Abeysekera what problems the Police were having in proceeding further with the trial. He said because of this
unnecessary delay on the part of the CID the suspects were being kept in remand.

Counsel Upul Kumarapperuma watching the interest of Mr. Premachandra’s wife said in this country the law is executed in two different ways.

“They enforce the law on the common man in one way and in a different way on the elite,” he said. He said on every inquiry date the police
came to court and said that they had sought the advice of AG on the matter.

President Counsel HemanthaWarnakulasuriya appearing for Duminda Silva said he needed to make certain clarifications to the submissions made
by the counsel. He said his client was taken to Singapore prior to him being named as a suspect in the killing.

Suspect Armbawelaga Don Kawshan Dananjana Madusanka Silva informed court to allow him to make statement in court.

Magistrate Prasanna Alwis ordered the Police to hand over the investigations report extracts to the Attorney General and  ordered the Prison Superintendent to file a report in Court  showing cause for not adhering the specialist’s order on the suspect Gamini. The
suspects were remanded till October 30. (FT)

    Lobo Wednesday, 17 October 2012 03:26 AM

As long as they were being served with the bigger silver spoon it was all ok. Now that they've suddenly been served with smaller plastic spoon they're starting to feel the pinch.

    DN Wednesday, 17 October 2012 02:48 AM

Very sorry to see Hirunika also supporting the same set people, who is responsible for this political culture.

    lalitha Wednesday, 17 October 2012 02:45 AM

Hirunika is using this to gain publicity to herself.... shes showing shes "looking for justice" but at the same time rubbing shoulders with the ppl who are protecting silva.. do not trust her!!

    Nodrog Wednesday, 17 October 2012 12:32 AM

After all these years you suddenly realized this only because your family was affected. Now you know how us ordinary folk feel?

    samba Tuesday, 16 October 2012 09:56 PM

Now dont cry...you are are a victim of what you (your brother) have created in this country. Your brother also must be responsible for such sitiuation.

    sam Tuesday, 16 October 2012 08:40 PM

All of you were silent for the last 64 years to the sufferings of the Tamils!! Chicken has come to roost!!

    sam Tuesday, 16 October 2012 08:35 PM

Keep voting the same people into power!!

    Maximilian Tuesday, 16 October 2012 07:22 PM

    Hussain Tuesday, 16 October 2012 06:28 PM

There seems to be no Justice, but Injustice all around in this island of ours. Who but ourselves are to be blames for these state of affairs, did we not elect them to govern us. So do not complain.

    Kondebendapucheena Tuesday, 16 October 2012 01:16 PM

One for Hirunika and One for Duminda you mean

Chanaka Weerasinghe Tuesday, 16 October 2012 04:50 PM

When your brother was alive ,he wasn't exactly the "Guardian of the justice and truth ' Type either . So shall we say what goes around comes around .

    Jesus Tuesday, 16 October 2012 04:40 PM

There are so many things to talk about rather than talking about a thug...who was killed by another thug....

dont insult us Tuesday, 16 October 2012 04:35 PM

absolutely correct ! Tell all those to late Baratha's wife and daughter not to the public. we are not idiots to listen to these crap.

    Minister Tuesday, 16 October 2012 04:30 PM

But your sister-in-law and the niece do not support your statements. Why?

    Begger Tuesday, 16 October 2012 02:22 PM

mahinda and his Law is prevailing in this country....uneducated and village people are behind him because they don't what's happening in Colombo ...

    Lal Tuesday, 16 October 2012 02:17 PM

You are absolutely correct, but the question is your sister in law (wife of late Baratha) and niece (daughter of late Baratha) both betrayed your brother. Do not get surprised one fine day if Duminda becomes a close associate of this family.

kapa ta pissu Tuesday, 16 October 2012 02:06 PM

You talk about justice being served with 2 spoons..then what about your sister in law getting a govt job, vehciel, fuel, house and allowances from president as his coordinator without any education, govt service, qualifications and seniority in service? What about those who go to uni , spend 5 years and slog in a govt dept for years to be a senior officer to get atleast a official vehicle? dont' they served with a different spoon then? All talks for your own benefit..ryt?

Calistus Jayatilleke Tuesday, 16 October 2012 02:00 PM

Try telling this to your niece who is getting on to the political stages of these very same murders.

Anil Perera Tuesday, 16 October 2012 01:46 PM

I think Swarna should get into politics too.

Impartial Guy Tuesday, 16 October 2012 01:46 PM

Madam, you are complaining that justice is served in two different spoons, one way to rich and another way to poor in this country. Do not forget that this is happening under current government. So, why Hirunika joined the government and addressed a gathering from a UPFA political stage. This thing also people consider as double standard. Telling people one thing and sitting with government. This is just like Hela Urumaya sitting with government, and fighting for the rights of the people. This is a joke. Hirunika, if you want to fight for justice for your father, get out of UPFA and join opposition and fight for your rights without being a laughing stock before people of this country.

    jc Tuesday, 16 October 2012 12:00 AM

who's poor is this story :) via DM Android App

    Mevan Tuesday, 16 October 2012 01:27 PM

"Charity is no substitute to justice witheld" sure enough but in this "miracle land" where idiotic voters can be hoodwinked with few packets of rice & curry justic is very pricy. Read what former CJ has to say about Helping Hambantota.
