My mother will not back down says CJ’s son

Shaveen Bandaranayake the son of Chief Justice Shirani Bandaranayake, who is facing an imminent impeachment motion in parliament in a note posted on Facebook, said his mother would not back down from anything and called on the citizens of the country to stand by her.

“An individual can live his or her life seeing the injustice around them, turn a blind eye and die a forgotten person. Or, he or she can take a stand against tyranny. The Chief Justice of the Democratic Socialist Republic of Sri Lanka is taking a stand. Which side you, the citizen takes, defines who we are as Sri Lankans,” he said.

When the Daily Mirror contacted Shaveen today, he confirmed he had posted the comment.

The following is the full comment sent to us by email:

“My mother is the 43rd Chief Justice of this country. She is also the first female Chief Justice in this country’s 200+ year history. She is an academic, one who possessed a PhD in Law before it went on sale. She is also a loving sister, mother and a wife. She is a hardworking woman who loves her country dearly and wishes to preserve its seemingly flailing integrity.

She is not a politician. She is not the kind of person who expects to do something and expect something in return. She is also not the kind of person who would waver or change under pressure or intimidation. She is not going to change her conscience on a whim. There have been many occasions in which she could have given in and been rewarded lavishly.

Most people are unaware of who my mother really is. Until recently, seldom would anyone have heard anything from her or about her. She has always believed that as a judge and as the Chief Justice, she must not socialize or be seen to favour any party. It is not that she is not a sociable person. It is purely because she feels it’s a burden she must carry in order to uphold the integrity of the august position which she holds. Is that incapacity? Is that misbehaviour? The powers that be claim the impending impeachment to be one to uphold democracy and the concept of separation of powers. Frankly, in my humble opinion, it is one of vengeance. It is one of spite and pure hatred.

There have been many people in support of my mother’s cause and I am both humbled and strengthened by it. Those who stand with us today, I feel, stand not just for my mother. They stand for the independence of the judiciary and a democratic society. My mother believes in this country and it’s people. She has been a citizen of this proud country for 54 years and have dedicated almost 32 years in various capacities for this country. The country has not betrayed her. It’s people have not betrayed her. Those who govern have betrayed the country it governs and the people who elected them.

My mother will not back down from anything and if I personally have a ounce of her courage, I consider myself fortunate. She has always fought for what is right and will do so until her last breath. An individual can live his/her life seeing the injustice around them, show a blind eye and die a forgotten entity. Or, you can stand up against tyranny and make a stand. The Chief Justice of the democratic socialist republic of Sri Lanka is making a stand. Which side you, the citizen takes, defines who we are as Sri Lankans!

I am fully against with this impeachment against CJ. The reason is the Majority of the Parliament is Rajapaksa supporters who are thugs, womenizers, murderers and corrupted ones and they do what ever President says and the impeachment is one man action.
However CJ was also should realise famous saying " Balloth Ekka Nida Gaththanam negitinna wenne Makkan Ekka kiyala"

Junior Citizen Saturday, 03 November 2012 12:09 AM

DM is giving publicity b'cause it is written by CJ herself and posted through son's FB - she okayed 18th A, Reversed Golden K order, disgracefully held on to while husband being prosecuted by bribery comm- She should go or thrown out.

We are highly proud to see your deep thoughts in understanding political corruptions in the country at very young age, even though your mum is being directly targeted in this case. This is a great example for the society.

    A citizen Friday, 02 November 2012 01:05 PM

Well said. We are far awayfrom Democracy. World will ignore us as uncivilized country

    Mahehs Saturday, 03 November 2012 12:11 AM

    Dear Shaveen,
As a son you’re correct. But, N. Silva to you’r mom, done a great injustice to this country. None of the CJ’s didn’t even try to correct the system & restore the justice in the judiciary until they face injustice. N.Silva is the person who made judiciary a brothel house. This is a good lessen to all the judges & lawyers who are going after politicians.

Mervin & Co may try some drama on this issue???

Stock Lover Sunday, 04 November 2012 04:08 AM

Few questions to the son; (These needs to be answered before pin pointing at others)
    1. How can NSB Chairman single handed without any approval go ahead with a investment of this size.

    2. How can he hold a position as a chairman when CJ was his wife? Isn't that a conflict of interest?

    3. Who did the research for the NSB purchase of shares? Was it done by an independent person or atleast by the investment committee?

    4. When NSB has options like JKH, HNB, COMB, and many blue chips why did they use public funds to invest in a company which is corrupted like TFC?

    5. Shouldnt the leagal system support development in the country and direct the government in the right direction? Not go against just for the sake of going against....

    sarath Saturday, 03 November 2012 12:22 AM

This will be a much better country, IF, the children of 10% of the POLITICIANS can give a similar statement.

    Raju Saturday, 03 November 2012 12:36 AM

What is this new love for CJ. When she was appointed these were the very people who shouted it was political patronage. At that time she was seen as a MR fan. Now what is this noise. More than her she it is her husband who is the villan. He is charged withh corrouption and misuse of funds at a state institution even late government has now brought chrges. This woman carries Bandaranayake name married to a Kariawasam. Then this boy also carries the name Bandranaike just to derive benefits attached to this name. A bogus son who know nothing about law and order should keep his mouth shut until proper legal procedure is completed.

Kingsley Wijesinhe Sunday, 04 November 2012 04:20 AM

There seem to be a lot of ignorant people posting comments here. Bandaranayake is the CJ's maiden name, and she has chosen to retain it instead of adopting her husband's name Kariyawasam. Many women do this now, maybe as a sign of their liberation or maybe because they have attained some degree of fame or eminence in a profession while unmarried and want to retain the recognition attached to their maiden names.

However, it is indeed strange that her son should call himself Bandaranayake instead of Kariyawasam. He may not know the implications. Usually a person adopts the mother's name if he or she is an illegitimate child. By adopting his mother's name the CJ's son is insulting both his father and his mother.

Silva de Mervin Friday, 02 November 2012 01:32 PM

Yes! He is now in the danger of 'beating himself up' on the road.

    Jaya Saturday, 03 November 2012 01:02 AM

It's strange the son to carry mother's surname rather than father's. I am unable to understand this logic or legal implications. He has not mentioned about is father's alleged involvement in illegal transactions. For CJ, hiding her spouse's information is a high hand act and it is a breach of trust and conduct.

everyone understand the injustice in Sri Lanka, but we do not know the full history of this cases to pass a judgement.

Hector Perera Friday, 02 November 2012 01:40 PM

I take my hats off for you son. Fight for it and you can start it. I guess thousands of people will rally around you. There were some comments about your father by some people who doesn't know Sri Lankan politics. My dear friends his father was carrying out the orders by the Regimadipathi. You will come to know the truth very soon, if you believe them. But he made a mistake carrying out them without resigning. This is a good lesson for the other law abiding educated citicenz not get in to that trap with this most corrupted Govt.

Sam thanks. atleast i am abit aware of the script of this latest drama of the wonderland

    Gune Sunday, 04 November 2012 08:15 AM

Actually that is good advice. Go back to how she became a judge in the supreme court. Her husband was offered the post at NSB on account of being CJ. When he took it (and did corrupt deals such as the TFC transaction) The son is a fool if he thinks his mother is innocent. She accepted the bribe now she has to face the consequences. I hope the opposition and Sri Lankan Lawyers manage to prevent the impeachment but the son should probably stay out of it and decide not to become like his parents.

    Juggu Friday, 02 November 2012 02:31 PM

    Next..he'll ban Facebook too.

    Gune Sunday, 04 November 2012 08:31 AM

If you go back to how she became a judge in the supreme court that is up for debate.

    Gune Sunday, 04 November 2012 08:37 AM

If you take a job got because your wife is CJ you are corrupt. If this corrupt behavior make you follow orders that are wrong that compounds the corruption.

Following orders is not an acceptable defense in a court of law. Ask CJ.

    Sumanasiri Friday, 02 November 2012 02:37 PM

They also have sons and daughters and when the pay back time comes earth will be too small for them to hide. We salute you for you courage. You've showed the different between a son of an educated lady and a son of a thuggery minister.

Wife is a better half of husband. Country will not forgive her husband for ammasing wealth using his position. With the indictment, she should have resigned but still holding the post, The loss of NSB is the loss of the country. This fellow will not get proper treatment until she holds the position. Both must sent to jail.

    ishan Saturday, 03 November 2012 05:57 AM

It would have been more informative to publish the conflict of interest rather than a FB post. Lets not pretend this is a case of a totally innocent CJ on the gallows.

Given the predicament of Mr Kariyawasam and his day in court. And the potential for the CJ to abuse her position. It makes sense that she steps down to allow for impartiality - she could be reappointed with her integrity intact afterwards.

If this CJ lacks such integrity or otherwise feels the need to cling onto power - then impeachment is fair game imho.

CJ has the REAL LEGAL opportunity now to defend her self according to constitution as stated in the daily mirror (UMP places its position-impeachment- Daily Mirror of 3rd). if that's the correct position, why worry. here is the real opportunity to be the real person or not. Face the facts, place on record the real legal position in defence, show the public the real and correct positionIn, Then you will have the majority on your side.

    With due respect to CJ

Why cannot we commence NEW forum to prevent who ever big wigs to use us to drum up support ONLY when the same dog begins to bite the owner. Talk openly and let's prevent this rot. REAL JUSTICE must be a fight we must go for.

Ok What you said about your mother may be correct. How about your father who was responsible for buying TFC shares for a huge sum which belongs to the people of this country.

And I suppose you are one of the few who has all those traits and the courage? Don't use big words if you don't know the meanings of them, it only exposes your ignorance. If you have a grievance with the Govt, take it elsewhere. Don't make this a forum to put forth your hatred, allegations and theories on what this country is. Leave if your'e not happy...good riddance!

These positions must be held by people who are qualified, capable, experienced and their immediate family members who have clean records in the law and order of the company. If any of the family member is found against law and order of the country, one should not wait until an impeachment to be brought up to vacate the position, but with due diligent step down from the position.

    Then the citizens will respect.

CJ was o.k.with govt.until govt.took a serious view on her husband conduct .She was angry and acted against government for personal grounds. Since there was a prima facie her husband is awaiting a trial in a court which is under her authority. In major misappropriation cases, wives are questioned.. Here it cannot be done. If she is honest, she must resign and allow the judge to hold fearless trial.. She is the wife of most corrupted person.
