My mother will not back down says CJ’s son

Shaveen Bandaranayake the son of Chief Justice Shirani Bandaranayake, who is facing an imminent impeachment motion in parliament in a note posted on Facebook, said his mother would not back down from anything and called on the citizens of the country to stand by her.

“An individual can live his or her life seeing the injustice around them, turn a blind eye and die a forgotten person. Or, he or she can take a stand against tyranny. The Chief Justice of the Democratic Socialist Republic of Sri Lanka is taking a stand. Which side you, the citizen takes, defines who we are as Sri Lankans,” he said.

When the Daily Mirror contacted Shaveen today, he confirmed he had posted the comment.

The following is the full comment sent to us by email:

“My mother is the 43rd Chief Justice of this country. She is also the first female Chief Justice in this country’s 200+ year history. She is an academic, one who possessed a PhD in Law before it went on sale. She is also a loving sister, mother and a wife. She is a hardworking woman who loves her country dearly and wishes to preserve its seemingly flailing integrity.

She is not a politician. She is not the kind of person who expects to do something and expect something in return. She is also not the kind of person who would waver or change under pressure or intimidation. She is not going to change her conscience on a whim. There have been many occasions in which she could have given in and been rewarded lavishly.

Most people are unaware of who my mother really is. Until recently, seldom would anyone have heard anything from her or about her. She has always believed that as a judge and as the Chief Justice, she must not socialize or be seen to favour any party. It is not that she is not a sociable person. It is purely because she feels it’s a burden she must carry in order to uphold the integrity of the august position which she holds. Is that incapacity? Is that misbehaviour? The powers that be claim the impending impeachment to be one to uphold democracy and the concept of separation of powers. Frankly, in my humble opinion, it is one of vengeance. It is one of spite and pure hatred.

There have been many people in support of my mother’s cause and I am both humbled and strengthened by it. Those who stand with us today, I feel, stand not just for my mother. They stand for the independence of the judiciary and a democratic society. My mother believes in this country and it’s people. She has been a citizen of this proud country for 54 years and have dedicated almost 32 years in various capacities for this country. The country has not betrayed her. It’s people have not betrayed her. Those who govern have betrayed the country it governs and the people who elected them.

My mother will not back down from anything and if I personally have a ounce of her courage, I consider myself fortunate. She has always fought for what is right and will do so until her last breath. An individual can live his/her life seeing the injustice around them, show a blind eye and die a forgotten entity. Or, you can stand up against tyranny and make a stand. The Chief Justice of the democratic socialist republic of Sri Lanka is making a stand. Which side you, the citizen takes, defines who we are as Sri Lankans!

    People who have gone to at least 5th level of school will understand what's happening here . All educated genuine Sri Lankans are with you . But I doubt to what extent they can make a stand .     1. CJ was friendly with MR until the TFC deal went bust and force Mr. Bandaranaike to step down from NSB
    2. And CJ was align with government until bribery commission start a case against Mr. Bandaranaike, who led the TFC deal while he was NSB chief
    Once after his husband marginalized from cooperate bodies CJ went against the MR and all this start. I may be wrong and if someone got more inside info, please inform the public, for this sudden changes...

    It would have been more informative to publish the conflict of interest rather than a FB post. Lets not pretend this is a case of a totally innocent CJ on the gallows.

    Given the predicament of Mr Kariyawasam and his day in court. And the potential for the CJ to abuse her position. It makes sense that she steps down to allow for impartiality - she could be reappointed with her integrity intact afterwards.

    If this CJ lacks such integrity or otherwise feels the need to cling onto power - then impeachment is fair game imho.

    These positions must be held by people who are qualified, capable, experienced and their immediate family members who have clean records in the law and order of the company. If any of the family member is found against law and order of the country, one should not wait until an impeachment to be brought up to vacate the position, but with due diligent step down from the position.

    1. How can NSB Chairman single handed without any approval go ahead with a investment of this size.

    2. How can he hold a position as a chairman when CJ was his wife? Isn't that a conflict of interest?

    3. Who did the research for the NSB purchase of shares? Was it done by an independent person or atleast by the investment committee?

    4. When NSB has options like JKH, HNB, COMB, and many blue chips why did they use public funds to invest in a company which is corrupted like TFC?

    5. Shouldnt the leagal system support development in the country and direct the government in the right direction? Not go against just for the sake of going against....

    There seem to be a lot of ignorant people posting comments here. Bandaranayake is the CJ's maiden name, and she has chosen to retain it instead of adopting her husband's name Kariyawasam. Many women do this now, maybe as a sign of their liberation or maybe because they have attained some degree of fame or eminence in a profession while unmarried and want to retain the recognition attached to their maiden names.

    However, it is indeed strange that her son should call himself Bandaranayake instead of Kariyawasam. He may not know the implications. Usually a person adopts the mother's name if he or she is an illegitimate child. By adopting his mother's name the CJ's son is insulting both his father and his mother.

    Actually that is good advice. Go back to how she became a judge in the supreme court. Her husband was offered the post at NSB on account of being CJ. When he took it (and did corrupt deals such as the TFC transaction) The son is a fool if he thinks his mother is innocent. She accepted the bribe now she has to face the consequences.
