Delayed justice

The Supreme Court today ordered to release a man who had to pay with his life behind bars for more than five years due to the careless and irresponsible conduct of the judicial and administrative authorities.

Liyana Arachchi Appuhamilage Shanthalal Jayawardena, a resident of Ambagaspitiya, Yakkala who was arrested on the suspicion of a murder in 2002 and had been remanded as he was unable to pay the cash bail imposed on him or find sureties. Further he continued to be in jail till August 2010 as discharge order issued on him by the Attorney General in 2005 was not properly communicated to relevant courts.

The Supreme Court ordered to release Shanthalal Jayawardena immediately when a fundamental rights application filed by him was taken up today. In addition the Supreme Court bench comprising Justices Saleem Marshoof, P. A. Ratnayake and S. I. Imam directed the Attorney General to inform the Secretary, Judicial Service Commission, Secretary to the Ministry of Justice and Secretary to the Prison and Rehabilitation to prepare suitable guidelines to prevent recurrent of such incident.

    Actually it is their families that suffer more than the remandees! This is not understood by those in authority.

    There are Regulations already in existence relating to Remand Prisoners! Why didn't the Prisons Officers follow them?

    Only guidelines to prevent such incidents in future? No punishment for the judicial and administrative officials concerned? No compensation for the victim?

    Not only the delay of the department of justice, the lapses of Police also not punishable in our country. No one will take it serious.
