General Sarath Fonseka must appear before the court martial next week and face the proceedings without disputing that junior officers appointed in the panel was an illegal move, the Defence Ministry said today.

Director General of the Media Center for National Security (MCNS) Lakshman Hulugalla told Daily Mirror online that the General or his lawyers did not have any valid reason to object the members of the panel and could not use this as an excuse from staying away.

He added that the General would be produced in court by the authorities even if he refused.

“There is no reason why he should not attend. The General is in army custody so he will be produced before the court by the authorities even if he refuses,” Hulugalla said.

The JVP said earlier today that lawyers of Sarath Fonseka will appear before the court martial on Tuesday to challenge the legality of trying the former Army Commander before a bench comprising officers junior to him in rank.

They added that Fonseka would not appear for Tuesday’s hearing. (Daily Mirror online)

Another one who picks up some garbage to facilitate his meal ticket. What does this man know about military law or judicial law. ???

    Friday, 12 March 2010 06:47 PM

The tribunal needs to work within the vested powers of the Act.

    Friday, 12 March 2010 07:47 PM

Hulugalla, please learn the law ...

    Friday, 12 March 2010 07:49 PM

This man is not a respected lawyer to talk on legal matters - just a mouthpiece of the government ...

    Friday, 12 March 2010 08:45 PM

He appears to be a coward, who cannot face charges!

    Friday, 12 March 2010 08:55 PM

    This is all a well-planned drama ...

    Friday, 12 March 2010 09:18 PM

'Big fish' will be brought in front of an International court.

    Saturday, 13 March 2010 12:10 AM

Let the people who know the law, handle this matter.

    Saturday, 13 March 2010 12:46 AM

Are they going to drag him like vwhen he was arrested ,if he refuse to attend.
What about the saying innocent until proven guilty.

    Saturday, 13 March 2010 02:22 AM

Anything can happen in Sri Lanka. But truth cannot hide for ever. It will bounced back after multiplying several times.

    Saturday, 13 March 2010 02:54 AM

    Friday, 12 March 2010 06:44 PM

Fonseka should face the charges bravely and prove his innocence, without hiding behind lame excuses.

    Saturday, 13 March 2010 04:30 AM

He is clean, what can he do when the case is framed?

    Saturday, 13 March 2010 05:03 AM

SF would have done worse to MR and Gota if he had won. Some people have already forgotten what he had said in election meetings. Besides why can't he proe his innocence

    Saturday, 13 March 2010 06:23 AM

What ever it is Fonseka should not behave like a coward face the charges and prove his innocence. If he is not guilty of the charges he should have the courage to face a trial.

    Saturday, 13 March 2010 08:26 AM

"JUSTICE HAS TO BE METED OUT BY A JURY OF HIS PEERS." UNDER CRIMINAL LAW OR ARMY REGULATIONS AND THIS IS BEING DONE BY A COURT MARTIAL

    Saturday, 13 March 2010 08:36 AM

he is an another dog who is used to have the left overs of his MR. That explains everything

    Saturday, 13 March 2010 10:01 AM

this would be a Kangaroo court.

    Saturday, 13 March 2010 10:06 AM

Exactly, as Kany says . What has SF got to fear IF, as he and his supporters say, he is "not guilty" of the charges? Why should he keep trying to dodge this issue?

    Sunday, 14 March 2010 01:20 AM

If not appear for court marshal, put him in Bogambara. This so called hero is a huge cost to our nation in many fronts, both locally and internationally.

    Monday, 15 March 2010 05:41 AM

GSF is framed, so what is the truth he has to face.???

    Monday, 15 March 2010 05:44 AM

I suppose Mr. Hulugalle has already made arrangements to lift him bodily to the Court! Will the press be allowed to catch this spectacle in camera?

    Friday, 12 March 2010 01:12 PM

Fonseka is ammunition to the dwindling JVP.

    Friday, 12 March 2010 11:20 AM

Now the fun begins. He who wields the biggest stick wins!

    Friday, 12 March 2010 11:21 AM

Junior or Senior makes no difference. If SF is clean, free
and honest he should face this Court Martial.

    Friday, 12 March 2010 11:29 AM

    Political Circus...

    Friday, 12 March 2010 11:40 AM

Might be the same way he was taken in to coustody !!

    Friday, 12 March 2010 11:45 AM

There is no higher rank officers in army than he was.

    Friday, 12 March 2010 12:35 PM

Mr. Kany, if there is no difference between senior or junior, will there be any governance in the army?

    Friday, 12 March 2010 12:44 PM

so it is easy. government has to give higher rank equal rank than to him.

    Friday, 12 March 2010 01:01 PM

It is like a student punishing a teacher.

    Friday, 12 March 2010 01:07 PM

hulugalle is only a state worker. he has a limit.

    Friday, 12 March 2010 01:11 PM

People in glass houses should not throw stones at others.

    Friday, 12 March 2010 11:15 AM

He definitely has the right to challenge a process if it is illegal. How could this person simply state that "HE CANNOT" do so

    Friday, 12 March 2010 01:14 PM

He should appear in court or it will be dire circumstances.

    Friday, 12 March 2010 01:26 PM

Dear Hulugalla, What happened to your "channel 9 case"

    Friday, 12 March 2010 02:13 PM

    Friday, 12 March 2010 02:20 PM

    Hi Fun !
I'm really sad about the fate of this country !!!

    Friday, 12 March 2010 02:49 PM

Exactly. Thats what SF tried to do during the presidential elections. The reports coming in show how hypocritical he was. (eg: Sha De Silva case)

    Friday, 12 March 2010 03:02 PM

FONSEKA knows all the rules & regulations of the army act, any way he is an expert in his line, none can challenge him

    Friday, 12 March 2010 03:04 PM

SF must NOT appear before a court martial. Who the hell is Lakshman Hulugalle?? Gotabaya and Mahinda should appear before a court martial and sentenced to the same term that they have decided on SF.

    Friday, 12 March 2010 03:07 PM

Do you know the legalities? Let the legal profession sort this out.

    Friday, 12 March 2010 03:07 PM

I agree totally and there shouldn't be any fear if SF has nothing to worry.

    Friday, 12 March 2010 04:19 PM

good for him /! taht's the spirit!
