The three year old child who had been forcibly taken away from his mother’s care in December 2013 at the Ambalangoda bus stand was produced today in the Balapitiya Magistrate’s Court with the beggar, the suspect who is alleged to have abducted the child. Magistrate Asanga Boderagama remanded the suspect until the 31st of this month, and also ordered the child to be sent to Kithulampitiya Ruhunu children’s home in Galle.
The child who has now turned four, on seeing the beggar in courts had run towards him crying “ I want to go with my father” displaying to those in court his attachment to an affectionate father. The suspect who took the child in his arms cuddled him and had kissed him showing love and tenderness.
The suspect identified as Loku Mudiyanselage Kamal alias Kalumalli a resident of Dambulla.
The child’s mother Nadaraja Jeewarani (22) was also present in court. When the suspect was produced before the magistrate he cried and said that the child was his son. Later he said that he had taken the child for adoption from his grandmother and that he loved him very much.
The magistrate directed the mother of the child to produce whatever documents she possessed to prove that the child was hers.
Attorney R.L.P. Lankadeva represented the rights of the child and his mother, while no lawyer represented the suspect. Further hearing was postponed for the 31st of October by the magistrate.

Clearly a harrowing and difficult situation but what prevails in the family division and the lower courts as directed is ; That inking on board the children act 1998 and the rights of the child, the courts invari a bly order shared custody and residence with access to the grand parents. The courts are clearly mindful that the adults need to be educated not to use the child as a pawn and fodder to redress personal differences and animus that may exist and pay due care and attention to the sociological psychological and physical welfare of the child. A social worker will be assigned to the case. Depriving the child to continue without equal access in the first instance is now frowned upon by the European courts.

Blood is not thicker than water in this case. It is love and affection. Politicians should expect the same.
