Colombo Chief Magistrate’s Court on Friday concluded the counter case filed by Malaka Silva, son of former Minister Mervyn Sliva, against Scottish Engineer James Cassserly who was allegedly involved in a brawl with Malaka Silva at a nightclub in 2014.
When the case was taken up before Colombo Additional Magistrate Shalini Perera, the Magistrate decided to conclude the counter case stating that there were no charges to be pursued against James Casserly.
Counsel S. Rodrigo, appearing on behalf of James Casserly informed that the case had been delayed for six years, further delaying the removal of his client as a suspect of the incident. He added that his client may still have to return to Sri Lanka in future to provide evidence.
On August 26, 2016, then Colombo Additional Magistrate Nishantha Peiris named James Casserly, who was allegedly involved in a brawl with Malaka Silva at a nightclub, as a suspect of the incident, following a counter-complaint filed by Silva.
Subsequently, the suspect James Casserly was released on a personal bail of Rs. 200,000 by the Magistrate.
Seven suspects including Malaka Siva, were arrested in connection with the alleged assault of a Scottish couple at a nightclub in Duplication Road, Colombo 03, on October 31, 2014.(Yoshitha Perera)

Okay, James Casserley has now been cleared in the counter case against him. What happened to the original case against Malaka Silva and six others? Is that case still pending?
