Full Face helmet ban: CMA complains to HRCSL

The Ceylon Motorcyclists’ Association (CMA) today complained to the Sri Lanka Human Rights Commission (SLHRC) stating that the gazette notice 2007/39 was a violation of human rights restricting a motorcyclist's right to safety.

As such it requested the HRC to nullify the gazette notice issued by Transport and Highways Minister Nimal Siripala de Silva.

In the complaint, the CMA cited the minister, Department of the Registration of Motor Vehicles (RMV) Assistant Commissioner J.A.S Jayaweera, National Council for Road Safety Chairman Dr. Sisira Kodagoda and Police Traffic Division DIG Palitha Fernando as the respondents.

CMA Secretary Chirantha Amarasinghe said the HRC officials accepted the fact that there had been a violation of Human Rights because while issuing the gazette notice, the subject minister had failed to consider Sri Lanka to be a democratic State.

"People have a right to mind their own security. It has left the motorcyclists in the lurch because they have been denied the right to select a helmet of their choice,” he said.

Mr. Amarasinghe said Clause 7 in the gazette notice made it mandatory for motorcyclists to wear only SLS-standard helmets, and that only a limited number of such helmets were available in the market.

The CMA has also complained to the UN International Children's Emergency Fund (UNICEF) and the International Monetary Fund (IMF) citing the threats posed to riders and pillion riders by the gazette notice.(Thilanka Kanakarathna)

    each person who has an issue with any law will write to the UZn seeking redress...MOST.NOT ALL who r fighting for a full face helmet are the ones who have ulterior motives...see if a father mom and kid using helmets would complain ..they wont...Only youngsters will complain coz they have different agendas...once its made law...try to abide by it...learn discipline... via DM Android App

    Yeah Right! Simply wearing a full face would save you from a proper accident. Full face Helmut is only for ulterior motives. Hang the safety.

    I don't think anyone who makes these laws rides a motorcycle. This is not about abiding by the law. This is a wrong law that make us riders less safe. A full face helmet protects you from wind rain and insects. If you fall I would prefer not to have my face scraping the tarmac.

    The purpose of the ban is to allow banks to keep their cheap security at the expense of the safety of thousands of riders. This is a lazy attempt by the police to show that they are doing something to protect the banks who are making massive profits on the other end of things.

    just repeal the law. allow only people who are serious to put on a helmet. but no full face helmets buddies. your safety is less important than the safety of most of us cos of misuse via DM Android App

    These full face helmets are not suitable for Sri Lankan roads with heavy traffic.The moment the rider wears this he cannot hear the the surrounding traffic and risk accidents are imminent.

    Most top branded helmets are full face so are racing ones. Seems our Minister does not know to wear a helmet or for that matter ever ridden a motocycle. Issue is just because it was used in robberies all law abiding citizens have to be sacrificed to sort this out. Policeman with absolutly no common sense can only agree to this. I recall when a bomb exploded via motocycle in colombo they banned motorcycles from entering then it went onto lorry etc., if this is the thinking of our leaders God help mother Lanka
