FR petition filed against election on June 20

A Fundamental Rights (FR) petition has been filed by Attorney-at-Law Charitha Gunarathne in the Supreme Court challenging the Election Commission's (EC) decision to hold the General Election on June 20. The Petitioner claims that the particular order published by the EC in the Extraordinary Gazette Notification No. 2172/03 dated 20-04-2020 is not constitutional and the EC should not be permitted to hold the General Election in a grim situation in the country. The Petitioner pointed out that, at this moment, the life of the people will be at a risk if the EC is continuing with the election and that there is no value to the concept of Right to Life. Explaining the reasons for not to hold the polls, the petitioner had mentioned that as at the filling of the FR application there are about 600 confirmed Covid-19 cases in the country and the death toll has risen up to seven persons. The petitioner further mentioned that each district has recorded to have found infected persons including the electorate from which the petitioner represents from. He also highlighted that according to the EC, nearly Rs.700 million are to be estimated to spend for the upcoming polls and the particular amount will be double if the country is taking extra preventive precautions, such as the practices followed by South Korea. In the petition, it was noted that even the Covid-19 fund has scarcely went over Rs. 700 million which is less than the colossal expenses yet to be incurred to the General Election. The petitioner also mentioned that on the other hand the government has yet not introduced any stimulus package to the crashed economy. He said many funds may needed in near future to revive the economy with the unprecedented unemployment which could come to light soon. In this manner the petitioner pleads that the EC should not be permitted to hold the 'illegal' election, spending enormous amount of money which could have used for the regaining of the country's economy and the welfare of the society. Chairman of the EC, Mahinda Deshapriya, Member of the EC, N. J. Abeysekera, Elections Secretariat Office, S. Rathnajeevan H. Hoole, Secretary to the President, P. B. Jayasundare, Director General of Health Services, Dr. Anil Jasinghe have been named as respondents to the petition. (Yoshitha Perera)
