The Colombo District Court today ordered the payment of Rs.187 million as compensation to Dr. Samitha Samanmali who was paralysed after an iron bar fell on her back during the MEDEX exhibition at the BMICH on February 15, 2008.

She was a medical student at the time tragedy struck her. The plaint filed by her stated that as a result of this injury she would not be in a position to lead a normal married life or to perform her duties as a medical doctor and would be confined to a wheelchair for the rest of her life. (TFT)

Deservedly a huge pay out. This should warn every govt. and private companies that standard safety measures at all such sites are a must.

It takes close to 6 years for a court verdict. this shows the efficiency of the legal system and the lack of proper resources to expedite the hearings. I'm sure that the lawyers charge for 6 years must be an exorbidant amount that Samitha will need to settle with this money.

Very good. She deserve it. Hopefully a village girl like myself will get same sort of compensation for similar accident.

Your argument is fallacy. According to your own argument this dictor not deserve any composaation as this accident is not a deliberately planned.

True enough ! but do u think killing a man and then saying sorry is OK? Doctors should have medical negligence insurance so that IF they make a mistake their insurance pays the victims......moreover doctors in SL think they are God send and need to be worshipped. Sorry to say that some of them do not have ethics,

Lets see how long they take to pay her the money. the court can order but who is going to supervise the payment??

    chandra Friday, 27 February 2015 04:25 PM

Some comments are towards doctors on their mistakes and carelessness. Although I am not belongs to that profession, what I would like to say that doctors are not doing mistakes deliberately. Mistakes can happen every profession.

Its great that she got her compansation before she meers the end.

My suggestion to Dr Samanmali- use the money to get a powered wheel chair, and a modified vehicle where you could take your powered w/c to the driving seat and driving with hand controls. Invest on good wheel chair cushions for pressure relief and see a urologist for your bladder regularly.

Brilliant. Superb comment Mr Mohideen. Doctors and others involved in medical care for patients should take the utmost responsibility and care. Who do injustice for innocent people should be fined in Millions and give it to the victim.

Nihal Amarasekera Friday, 27 February 2015 12:02 PM

Definitely deserves, who is going to pay, BMICH management or who?

    Jane Friday, 27 February 2015 03:09 PM

Very good, why not similar judgements can not be passed on to doctors and hospitals who whose misadventures and negligence cause untold misery to helpless victims. One such case is roasting a patient inside a MRI scanner at a leading hospital and putting her dead body in a ICU and then charging these poor victims with millions of bills ? ?? ? ? ?

    Doc - KSA Friday, 27 February 2015 03:00 PM

Our judiciary is reinstated. Congrats, but why did they take so long time to issue the verdict..

at least this would allow her to try newest of the medical technologies in developed countries to see if it is possible to rectify her current condition.

You are a profile of courage, Samitha. You deserve every single cent of this compensation. WE wish you happiness in your life. As you once said Sri Lankan psyche is not real. They think only of war victims and not this type of sufferers. Let us change it!

Welcome the judgement. Similar judgments should be pronounced on medical professionals whose misadventures and negligence cause untold misery to helpless victims.
