President has no power to dismiss PM - Vajira

The President does not have the power to dismiss a Prime Minister according to the 19th Amendment to the Constitution, Home Affairs Minister Vajira Abeywardene said today.

Minister Abeywardene told the media that the stability of the government has been ensured by the 19th Amendment to the Constitution which was enacted in April 2015. He also said the President also could not dissolve Parliament till four and a half years of Parliament's term is completed.

"The mandate given by the people in January 8, 2015 still remains intact. A new president was elected in 2015 but the mandate received by the local bodies in 2011 remained unchanged till their terms were over. The situation remains the same now as well as the mandate received by the Sri Lanka Podu Jana Party is different while the mandate received in 2015 is separate," the Minister said.

The minister added that the mandate of 2015 remains the same as all the parties who asked for a mandate for a change in 2015 has got a total percentage of 55 percent at this year's local government election.

He added that those who made statements were not aware of the real situation. "The statements that have been made so far are not in line with the Constitution" he added. (Yohan Perera)

    In the first instance what is the necessity for a change and for the Prime Minister to step down? If the reason is that the UNP led by Ranil Wickremasinghe, the Prime Minister has been defeated at the local polls, what about the UPFA and SLFP led by the President, which have suffered a humiliating defeat, many times worse than the UNP? If the stupid logic of some fools is to be considered it should apply first to the President who is the leader of the two Parties which are in partnership with the UNP in the Govt.

    If the then newly elected President Sirisena could appoint an MP (Ranil) who commanded just 40 seats as PM without removing the then PM with over 140 seats, why couldn't he do the same thing again? Surely there is no clause in the 19th amendment that says; he should offer the PMs job to the MP who could command over 113 seats in parliament.

    Why dismiss the PM? Just as President Sirisena disregarded the reigning PM Jayaratna when he appointed Ranil as the PM, Sirisena may replace Ranil too with whomever he deem to 'think' commands the majority. 19A had not touch that prerogative of the President.

    It seems the 19th amendment prevents the President to remove the PM. But what if the opposition has the majority in the Parliament and brings a motion and votes in favour for the removal of the PM?
